Privacy policy of Sunexx GmbH

This detailed privacy policy is written in German language (because our key market is Germany) and the legal framework for the data protection is the German Federal Data Protection (Bundesdatenschutzgesetz BDSG) and the German Telemedia Act (Telemediengesetz TMG).
Legally relevant / binding is the German text. This is only a non-binding translation for rough orientation.

The legal basis for data protection can be found in the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).

Access data/server log files

Sunexx (or its web space provider) collects data about each access to the offer (so-called server log files). The access data includes: Name of the website accessed, file, date and time of access, volume of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider. Sunexx uses the log data only for statistical evaluations for the purpose of the operation, security and optimisation of the offer. However, Sunexx reserves the right to check the log data retrospectively if there is a justified suspicion of unlawful use on the basis of concrete indications.

Handling of personal data

Personal data is information that can be used to identify a person, i.e. information that can be traced back to a person. This includes the name, email address or telephone number. But also data about gender, date of birth, age, preferences, complaints, hobbies, memberships or which websites were viewed by someone count as personal data. Personal data is only collected, used and passed on by Sunexx if this is permitted by law or if the user consents to the collection of the data.

Contacting

When contacting Sunexx (for example via contact form or e-mail), the user’s details are stored for the purpose of processing the enquiry and in the event that follow-up questions arise.

Comments and contributions

When users leave comments on the blog or other contributions, their IP addresses are stored. This is done for the security of Sunexx in case someone writes unlawful content in comments and posts (insults, forbidden political propaganda, etc.). In this case Sunexx itself can be prosecuted for the comment or post and is therefore interested in the identity of the author.

Comment subscriptions

Follow-up comments can be subscribed to by users. Users will receive a confirmation email to verify that they are the owner of the email address entered. Users may unsubscribe from ongoing comment subscriptions at any time. The confirmation email will contain instructions on how to do so.

Newsletter

With the newsletter we inform you about us and our offers. If you would like to receive the newsletter, we require a valid email address from you as well as information that allows us to verify that you are the owner of the given email address or that the owner agrees to receive the newsletter. No further data will be collected. This data is only used for sending the newsletter and will not be passed on to third parties. When you register for the newsletter, we store your IP address and the date of registration. This storage serves solely as proof in the event that a third party misuses an email address and registers to receive the newsletter without the knowledge of the authorised person. You can revoke your consent to the storage of the data, the email address and their use for sending the newsletter at any time. The revocation can be made via a link in the newsletters themselves, in your profile area or by sending a message to the contact options above.

Integration of third-party services and content

It may happen that third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites, are integrated within this online offer. This always assumes that the providers of this content (hereinafter referred to as “third-party providers”) are aware of the IP address of the user. Without the IP address, they could not send the content to the browser of the respective user. The IP address is therefore necessary for the presentation of this content. We endeavour to only use content whose respective providers only use the IP address to deliver the content. However, we have no influence if the third-party providers store the IP address, e.g. for statistical purposes. Insofar as this is known to us, we inform the users about it.

Cookies

Cookies are small files that make it possible to store specific, device-related information on the user’s access device (PC, smartphone or similar). On the one hand, they serve the user-friendliness of websites and thus the users (e.g. storage of login data). On the other hand, they serve to collect statistical data on website use and to be able to analyse it for the purpose of improving the offer. Users can influence the use of cookies. Most browsers have an option to restrict or completely prevent the storage of cookies. However, it is pointed out that the use and in particular the user comfort will be limited without cookies. Google Analytics

Sunexx uses Google Analytics, a web analytics service provided by Google, Inc (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about the use of this website by the users is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymisation is activated on this website, however, Google will truncate the user’s IP address beforehand within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. IP anonymisation is active on this website. On behalf of the operator of this website, Google will use this information for the purpose of evaluating the use of the website by users, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. Google-Ads

Sunexx uses Google-Ads, an advertising tool of Google Inc. in combination with the evaluation program “Conversion Tracking by Google (“Google”). If a user comes to the Sunexx website via a Google ad, a cookie will be stored on the user’s computer, enabling an analysis of their use of the website. These cookies usually lose their effect / expire after 30 days and cannot be used to identify the user. The information generated by the cookie about the use of this website by the user is usually transmitted to a Google server in the USA and stored there and is used to identify that the user was redirected from a Google advertisement to the Sunexx website. These cookies are used to evaluate advertising effectiveness and for statistical purposes.

Cookies can be blocked by generally deactivating cookies in the browser.

Google reCAPTCHA

We use the Google service reCaptcha to determine whether a human or a computer is making a certain entry in our contact or newsletter form. Google uses the following data to check whether you are a human or a computer: IP address of the terminal device used, the website you visit with us on which the captcha is embedded, the date and duration of the visit, the recognition data of the browser and operating system type used, Google account if you are logged in to Google, mouse movements on the reCaptcha areas and tasks that require you to identify images. The legal basis for the described data processing is Art. 6 (1) lit. f of the General Data Protection Regulation. There is a legitimate interest on our part in this data processing to ensure the security of our website and to protect us from automated entries (attacks).

Use of social media plugins/components

Facebook

Sunexx uses social plugins (“plugins”) of the social network facebook.com, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). The plugins are recognisable by one of the Facebook logos (white “f” on a blue tile, the terms “Like”, “Like” or a “thumbs up” sign) or are marked with the addition “Facebook Social Plugin”. When a user calls up a Sunexx website that contains such a plugin, their browser establishes a direct connection with Facebook’s servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated by it into the website. Sunexx therefore has no influence on the scope of the data that Facebook collects with the help of this plugin and therefore informs users according to its level of knowledge:

By integrating the plugins, Facebook receives the information that a user has called up the corresponding page of Sunexx. If the user is logged in to Facebook, Facebook can assign the visit to his or her Facebook account. If users interact with the plugins, for example by clicking the Like button or posting a comment, the corresponding information is transmitted directly from their browser to Facebook and stored there. If a user is not a member of Facebook, there is still the possibility that Facebook will find out and store his or her IP address. According to Facebook, only an anonymised IP address is stored in Germany.

If a user is a Facebook member and does not want Facebook to collect data about him or her via this offer and link it to his or her membership data stored on Facebook, he or she must log out of Facebook before visiting the website. X (formerly Twitter)

LANG uses the buttons of the X service (formerly Twitter). These buttons are offered by X Corp, 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. Twitter International Company, One Cumberland Place, Fenian Street, Dublin 2 D02 AX07, Ireland, is responsible for the data processing of persons living outside the United States. They can be recognized by terms such as “X”, “Twitter” or “Follow”, sometimes combined with a stylized bird logo. With the help of the buttons it is possible to share a post or page of this offer on Twitter or to follow the provider on Twitter.
We would like to point out that you use the X short message service offered here and its functions at your own risk. This applies in particular to the use of the interactive functions (e.g. sharing, rating).

When a user accesses a LANG website that contains such a button, their browser establishes a direct connection with the X servers. The content of the X button is transmitted by X directly to the user’s browser. LANG therefore has no influence on the scope of the data that X collects with the help of this plugin and informs users according to its level of knowledge. According to this, only the user’s IP address and the URL of the respective website are transmitted when the button is accessed, but are not used for purposes other than displaying the button.

Youtube

Sunexx uses Plugins von YouTube, which is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

When a user calls up a Sunexx website that is equipped with a YouTube plugin, a connection is established to the YouTube servers. In doing so, the YouTube server receives information about which specific Internet page of Sunexx was called up. In the event that the user has logged in with his YouTube account, YouTube has the possibility to assign the user’s surfing behaviour directly to his personal profile.

If you as a user do not want YouTube to collect such information about you, you must log out of YouTube before visiting the Sunexx website. Sunexx therefore has no influence on the scope of the data that YouTube collects with the help of this plugin.

Instragram

Sunexx uses Plugins von des Netzwerkes Instagram, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304 United States (“Instagram”).

When a user calls up a Sunexx website and clicks the “Instragram” button, Instagram receives the information that the user has called up the corresponding Sunexx internet page – with transmission of his IP address. In the event that the user has logged in with his or her Instagram account, Instagram also has the option of assigning the user’s surfing behaviour directly to his or her personal profile.

If you as a user do not want Instagram to collect such information about you, you must log out of Instagram before visiting the Sunexx website.

Sunexx therefore has no influence on the scope of the data that Pinterest collects with the help of this plugin and how this data is further processed.

Appointments/consultations via calendly

We use the tool calendly to make appointments easily, quickly and without complications. We use calendly to improve our service for existing and new customers/prospects. This constitutes a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO. When using the tool, you will be asked for personal data such as name, e-mail address and telephone number. You also have the opportunity to present your request and provide us with further information. If you use the tool, your details from the enquiry form, including the information you provide there, will be stored and, of course, transmitted on the Internet. The data entered is processed exclusively on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). This privacy policy and the provider’s privacy policy apply to the handling of data collected through the use of calendly. The online offer of Sunexx contains links to other websites. This data protection declaration only applies to the website of www.sunexx.de and www.sunexx.com  and not to other providers. Sunexx has no influence on whether the operators of these websites comply with the data protection regulations and therefore accepts no responsibility for the accuracy, up-to-dateness and completeness of the information provided there.

Revocation, changes, corrections and updates

The user has the right, upon request and free of charge, to obtain information about the personal data stored about him or her. In addition, the user has the right to correct incorrect data, block and delete his or her personal data, insofar as this does not conflict with any legal obligation to retain such data.
